When we gather information, we store it in log files.  We use this information with the intention of  analyzing the data and optimizing our website and communications to be more effective. Some of the ways we do this is by using cookies. Cookies, not the kind you eat, but rather the files stored on your computer by a website. We typically use cookies with third-party service providers (Google Analytics) like log files, to help us to optimize our communication and our website, with the goal of streamlining processes and information, and avoiding any unnecessary steps for the user.  Cookies are used to remember your email and password and may be used by you on sites like ours to generate your personal information (address, email, etc) and to help remember preferences. Web beacons are also used to help us track use across the pages of our website and/or email campaigns.

COPPA Notice

COPPA or the Children’s Online Privacy Protection Act (“COPPA”), was created to protect children and it requires that we provide you with direct notice before collecting information considered to be “personal information” from your child that is under the age of 13. To read all the details of  COPPA, visit https://www.consumer.ftc.gov/articles/0031-protecting-your-childs-privacy-online

The Federal Trade Commission considers, for example among other items, a photograph, video or audio file containing a child’s image or voice to be a child’s “personal information.”

Registration of your child(ren) at Jen’s Camp, gives your child(ren) or the child(ren) that you are the guardian of, access to many activities and programs, including some that utilize computer software applications and web-based services that are not operated by Jen’s Camp but by third parties. It is possible that in order for the campers to engage/use some of the programs and participate in certain activities, certain other personally identifying information, including a user name and/or email address, must be provided to the website operator. Through some of these applications and software, your child(ren) may create or be captured in a photo, video, or audio project(s) or software applications.  Thus, these applications may contain images, audio or video of your child(ren)’s image(s) or voice(s) and work.  For some of the programs, we can simply use the email you register with to create an account, in other situations, you will receive an additional email from us asking you to enroll in the program, thereby creating an account for your child(ren) or the child(ren) that you are the guardian of to use.  The reason is, under federal law, these websites must provide parental notification and obtain parental consent before collecting personal information from children under the age of 13.  Again, for more information on the Children’s Online Privacy Protection Rule (“COPPA”) and its regulation, please visit: https://www.ftc.gov/tips-advice/business-center/guidance/complying-coppa-frequently-asked-questions.

To go into greater detail, your child(ren) may utilize the third-party services to create projects at Jen’s Camp that may contain your child(ren)’s image(s) or voice(s), and are uploaded by your child(ren) (rather than by you), in an abundance of caution we are providing this notice. This is the only “personal information” that will be collected from your child(ren). It will not be used for any other purpose, disclosed, or combined with any other information from your child(ren). Your consent is required for the collection, use, or disclosure (to the accounts you have created for your child(ren) as indicated herein). If you do not consent, your child(ren) will not be able to register for Jen’s Camp.

I understand that I can also revoke my consent and refuse the further use of the applications by my child(ren) while at Jen’s Camp by canceling my child(ren)’s camp participation and/or enrollment.

By participating in or registering for Jen’s Camp programs, events or activities in both the ‘season’ hereby determined as a unit that you have registered your camper, or a camper that you are the guardian of (hereby referred to as ‘your camper(s)’ or ‘camper(s)’), for or ‘pre/post season’ referring to any activity, program or event that your camper, or a camper that you are the guardian of, participates in or attends that is occurring outside of a unit (week) or ‘season’ of camp, your camper will have the opportunity to participate and use our various programs, third party applications, and create or view created audio, photo and video files that may contain your campers image or audio as well as the image or voice of other campers and/or staff/vendors at Jen’s Camp or on the premise.  Our staff and/or your camper may upload an audio, photo/image, or video file to a third party app we partner with and/or our designated storage space(s) accessible by the email address you and other parent/guardians use(d) when registering for Jen’s Camp.  Both yourself and other parent(s)/guardian(s) registered or who have registered for Jen’s Camp program, activities, or events are able to access all these audio, photo/image, or video files.  During our events, program and/or  activities because your camper and/or other campers and/or children are creating content, may contain your camper’s audio, voice, image and may be uploaded by your camper and/or other campers or Jen’s Camp staff (versus by you) to our third party software, apps, or designated storage space, the FTC may and can classify this as ‘collecting’ your campers personal information.  We should also clarify that ‘other’ children could be captured due to the public nature of some events, activities, and or programs.   Your consent is required for the collection, use or disclosure of your campers information as may appear in a audio, photo or video file as well as in project(s) or applications such as software applications that your child creates, collaborates, participates in, or was included in as part of Jen’s Camps events, activities or programs.   Hereby your consent authorizes the collection, use or disclosure of your campers information as may appear in the above listed manners including audio, photo, video files, projects and/or software application to children/campers, parents/guardians of children, Jen’s Camp staff and third party contractors of Jen’s Camp as well any third parties who may receive your campers information from other campers/children or parents/guardians who attend Jen’s Camps events, programs, activities or were included in them with your camper.  We will not intentionally collect, use, or disclose any such information from your camper/child if you do not consent.   If you do not provide consent to the collection of your camper’s personal information as described above, your child/camper will not be able to participate in any of Jen’s Camp pre/postseason or in season events, activities or programs.  You can contact us and alert us that you no longer want to provide this consent at any time.  In that circumstance, we will remove the email address you provided us from access to our shared storage space and if requested remove any specific images from our website (jenscamp.com).

We may change this COPPA Notice.  An updated version will be available via jenscamp.com or other manners we deem appropriate/necessary.  Since we do reserve the right to modify and change this privacy statement at any time, please review it frequently.   If you cannot find an updated notice, you can reach out via the email address or phone number provided on our website and request the most current version of the notice.

We do reserve the right to disclose your and your campers personally identifiable information as required by the law and when we believe that disclosure is necessary to protect our right and/or to comply with a judicial proceeding, court order, or legal process.
